Ex- Federal Bureau of Investigation Staff Member Alleges Wrongful Dismissal Due to Pride Flag Exhibition
An experienced FBI operative has filed legal action claiming he was let go on account of exhibiting an LGBTQ+ banner at his desk area.
Based on the former employee, that served in the agency since 2009, the dismissal recently is being described as “improper and biased”.
Court Case Asserts Constitutional Infringements
The legal filing contends that the agency violated the employee’s First Amendment freedoms and engaged in retaliatory measures against him due to participating in protected communication.
Maltinsky is seeking a judicial directive to reinstate his position within the agency.
Information from the Complaint
The detailed filing, lodged in federal court in the nation’s capital, states that Maltinsky was dismissed from the FBI academy in October over previously exhibiting the banner on his desk.
Per the complaint, the Pride flag was given to the employee to honor his work to advance the FBI’s equality efforts.
Early on, my only desire was to serve the nation and safeguard public safety alongside the talented and committed personnel in the bureau,” remarked the plaintiff.
He continued, “I displayed that Pride flag – which in 2021 was raised before the Wilshire federal building – not to make a political point, but as a symbol of diversity, togetherness and fair treatment.
These principles that helped build the FBI strong. Currently it stands as where people like me are targeted. I am convinced I was dismissed not on account of my person, but what I am: an openly gay individual,” he said.
Unexpected Dismissal Just ahead of Completion
Recently, the plaintiff gained admission to the bureau’s agent training academy at Quantico, Virginia, up until what he called “abrupt dismissal just three weeks before finishing”.
The lawsuit additionally states that eventually subsequent to the presidential inauguration, an colleague reported an issue to the overseeing official about the presence of the LGBTQ+ symbol.
To be safe, the plaintiff sought that the top lawyer at the L.A. office review if the exhibition of the symbol was permissible,” the complaint stated.
It further mentioned, “The Chief Division Counsel advised Maltinsky that the display of the flag was not against any bureau guidelines.”
Notification of Termination
Despite this, on the first of October, the employee was notified of his termination.
In correspondence mentioned in the complaint, bureau chief the official commented, I have concluded that you used poor judgment with the presence of a political symbol in your work area during your previous assignment at the Los Angeles Field Office.
“Pursuant to federal law of the Constitution, and statutes of the United States, your employment at the bureau is concluded.”
Lawyer Remarks
In a release released on Wednesday, his legal representative Kerrie Riggs stated, “This administration’s illegal termination is a component of an extensive initiative to rid public offices of workers with divergent opinions, or are from underrepresented communities, or individuals that oppose prejudice.
His case is not just about him, but also about ensuring the entitlements and freedoms of every government worker.”
Agency Reply
The FBI refused to respond about the legal action.
