Trump Asks Top Court Approval for National Guard Troop Deployment in Chicago Area

This step is part of a wider effort to widen the domestic use of the armed forces in several cities run by Democrats.

Judicial Challenge Over Troop Deployment

In an urgent petition, the US Department of Justice urged the judiciary to reverse a lower court ruling that had halted the stationing of several hundred military reserve personnel to the greater Chicago.

The district judge had expressed skepticism about the White House's explanation for sending troops, questioning its explanation in light of regional circumstances.

A higher court affirmed the initial ruling on the previous day, maintaining the activation on standby while the court case proceeds.

White House's Claims

The top government lawyer, speaking on behalf of the administration, claimed in the new filing that government officers have often been “intimidated and assaulted” in downtown Chicago and the neighboring town of Broadview.

This area is home to an Immigration and Customs Enforcement holding center.

The former president has earlier sent military reserve forces to Chicago and Portland, Oregon, following previous activations to LA, the city of Memphis, and Washington DC.

The president has stated that armed forces involvement is necessary to reduce protests and bolster border control.

Partisan Opposition

Democratic officials have pushed back sharply the decision, claiming that the White House's statements are inflated and partisan in nature.

They allege the former president of misusing his authority to target political rivals.

Court officials have also raised questions about the administration’s depiction of ongoing incidents.

Local leaders claim that rallies over deportation policies have been largely limited and calm, contradicting the president’s characterization of “battlefield” conditions.

Statutory Grounds

At the heart of the conflict is the administration's application of a federal statute allowing the president to take control of the state guard only in cases of uprising or when “powerless with the standard military to execute the statutes of the United States”.

The administration insists that the troops are essential to safeguard US facilities and officers from activists.

Recent Events

In recent weeks, the White House federalized several hundred troops of the Illinois national guard and ordered more Texas national guard troops into the state.

As local leaders condemned the decision, the president escalated his rhetoric, calling on the arrest of Chicago’s mayor and the state's chief executive, each a Democrat, alleging them of neglecting to protect federal agents.

The state of Illinois and the city of Chicago together took legal action against the administration to block the deployment.

On 9 October, the presiding federal judge, nominated by President Biden, delivered a preliminary order preventing the order.

Local Incidents

Simultaneously in Chicago, at least a dozen people were detained outside the federal detention center following heated confrontations between state law enforcement and demonstrators.
